As with much of the world, real estate remains a virtually bulletproof investment opportunity in the UK. One of the most common questions foreign investors have is whether they require a visa for the UK, and if so, which type of visa. Owning property in the UK does not automatically grant you residency rights or visa opportunities, but there are several immigration routes available to explore:
Skilled Worker Visa
This visa allows you to do an eligible job in the UK with an employer who has a sponsor licence. After 5 years on this visa, you can apply to settle permanently in the UK (indefinite leave to remain). This route will require a UK company to be set up, and if your occupation is eligible, your role may be sponsorable through this route. There is also a need to open up a UK bank account, which Redfern Legal can provide options for.
UK Expansion Worker Visa
If you have an existing business overseas which has been established for at least 3 years, and if you have already worked for this company for at least 12 months or more, you can come to the UK. This visa will allow you to set up a branch of an overseas business not yet trading in the UK. You can stay for up to 2 years on this visa, but it does not lead to settlement rights, so you will then need to switch to a different visa type once the 2 years are up.
Senior or Specialist Worker Visa
Should your company have already started operating in the UK, you could get a senior or specialist worker visa. You can stay in the UK for a maximum of 5 to 9 years, depending on your circumstances. However, this route does not allow you to settle permanently in the UK, so you will need to eventually switch to a different visa type to become a permanent resident.
High-potential Individual Visa
If you have graduated from an eligible university (top 50 global universities) in the last 5 years, you could be eligible to work in the UK for 2 years (or 3 years with a PhD). This route does not require sponsorship or even a job offer. This visa does not lead to settlement, but it gives you time to switch to another visa in the country later.
Innovator Founder
This visa is available if you have an innovative, viable and scalable business idea which is a novelty in the UK. You will then apply to an endorsement body, and once endorsed, you can have a visa for 3 years, which can be extended for an additional 3 years. If the requirements are met, it can lead to indefinite leave to remain in the UK after 3 years.
Global Talent
If it has been demonstrated that you are an outstanding talent in your field, including academia, research, STEM, arts, culture, or digital technology, you can apply for endorsement to the relevant endorsement body, and once endorsed, you can apply for a visa for 3 years. When the 3 years are over, you can apply for indefinite leave to remain.
The UK immigration system is complex, shaped by statutes, case law, frequent changes, official guidance, and political influences. Navigating this landscape requires the expertise of qualified Immigration Practitioners who can guide you from the very start of your journey.
